    Ahmedabad: Gujarat's junior Home Minister Amit Shah, who is close to Chief Minister Narendra Modi, was on Thursday summoned by the CBI in the Sohrabuddin Sheikh fake encounter case but he failed to appear and has been asked to show up on Friday for questioning.

    It is for the first time that a state minister has been summoned in connection with the alleged fake encounter by Gujarat Police near Ahmedabad in which Sohrabuddin, an alleged gangster, was killed in November 2005.

    The CBI issued a second summons to the minister of state for home to appear before it at the agency's office tomorrow after he did not show up within the stipulated time of 1 PM today. The Minister has again been given time till 1 PM tomorrow. Modi holds the Home portfolio.

    The investigating agency has the option of issuing a third and final summons before considering declaring Shah an absconder or issuing an arrest warrant.

    "(Amit) Shah has been asked to appear before us today at CBI office in Gandhinagar," CBI IG P Kandaswamy told PTI.

    The state Government said it will cooperate with the process of law on the issue of summons to Shah.

    "I have come to know about it (issue of summons) from media. Whatever is the process of law one would follow it," Government spokesman and Health Minister Jaynarayan Vyas said.

    Shah has been recently skipping cabinet meetings including the one held yesterday and not attending office.

    The minister's absence from the cabinet meeting fuelled media speculation that he might be arrested by the CBI in connection with killing of Soharabuddin Sheikh.

    The State BJP, meanwhile, lashed out at the Congress for "misuse" of CBI.

    "The Congress is misusing the CBI against BJP-ruled states," BJP leader and MP Vijay Rupani said in Rajkot.

    "Many encounters have taken place in several other states, but the party (Congress) is not keen on demanding CBI investigations in those cases," Rupani said.

    In New Delhi, Congress spokesman Manish Tiwari said there should not be any politics on the issue of probe in the Sohrabuddin case.

    "The maxim that however high one may be, law is above you prevails," Tiwari said in New Delhi.

    The CBI took over the investigations of the fake encounter and mysterious murder of his wife Kausar Bi in January this year on the direction of the Supreme Court.

    The CBI arrested DCP Abhay Chudasama, the fourth IPS officer to be arrested in the fake encounter case.

    Earlier, state CID investigating the case had arrested D G Vanzara and Rajkumar Pandian, both IPS officers of Gujarat cadre and Dinesh M N, IPS from Rajasthan in the case along with 10 other policemen.

    The CBI has also demanded from state CID to hand over documents related to Tulsi Prajapati encounter case as they believe that Tulsi was a key witness in fake encounter of Soharabuddin.

    However, state CID swinging into action has arrested IPS officer Vipul Agarawal and three others in the Tulsi Prajapati encounter case.

    Fake encounter: Guj Min no show to CBI summon

    It is for the first time that a state minister has been called for questioning the fake encounter case on 2005, which has already landed at least four IPS officers in jail.

    Shah, a close aide of chief minister Narendra Modi, could face an absconder notice or arrest warrant if he fails to appear before the CBI on Friday and the investigating agency decides to put out a third and final summon on Shah, to which also the minister doesn’t respond.

    The Gujarat government has extended all cooperation to the probe and government spokesperson Jaynarayan Vyas said, “I have come to know about it (issue of summons) from media. Whatever is the process of law one would follow it.â€￾

    Meanwhile, Congress spokesperson Manish Tiwari said in New Delhi, “There should not be any politics on the issue, but justice should be done.â€￾

    He said ever since the BJP government took office in Gujarat , especially after Narendra Modi became chief minister, there have been various such instances.

    “All we are interested is that justice is done and law should be above everyone, however high the person is,â€￾ he said.

    Meanwhile, the BJP, defending the home minister, said the CBI is prejudiced against opposition politicians.

    “The Congress manipulates the CBI,â€￾ said BJP spokesperson Ravi Shankar Prasad.

    Sohrabuddin was killed in an alleged fake encounter in November 2005. Although police said he was a terrorist and planned to kill Narendra Modi, investigations have revealed that the encounter was fake.

    Three senior police officers from Gujarat and one from Rajasthan have already been arrested for their involvement in the case.

    Telephone records have shown that Shah was in regular touch with these officers, reports said.

    Amit Shah fails to show up before CBI

    GANDHINAGAR: Gujarat Minister of State for Home Amit Shah on Thursday failed to respond to the summons issued by the Central Bureau of Investigation for questioning in connection with the Sohrabuddin Sheikh fake encounter case.

    The CBI, however, issued fresh summons to him, asking him to come to its office here by 1 p.m. on Friday.

    Mr. Shah said he would abide by it and be present at the CBI office in time. The reason for his failure to turn up on Thursday was the “late issuanceâ€￾ of the summons.

    “Not on the runâ€￾

    In a statement, the Minister said he was out on some personal work and did not receive the CBI intimation in time. “I am not on the run and I will be there to answer all questions of the CBI tomorrow [Friday].â€￾

    Advocate Mahesh Jethmalani said Mr. Shah would respond to the CBI summons on Friday.

    According to informed sources, the CBI was looking for the Minister to serve the summons but could not locate him at any known place. Finally, the summons, asking him to appear by 1 p.m. on Thursday, was pasted on the wall of his Naranpura residence in Ahmedabad in the morning.

    A copy of the summons was sent to his ministerial bungalow here and another handed over to his office staff at the Secretariat building here. But he was untraceable till the appointed time.

    CBI DIG P. Kandaswamy, who is heading the investigation team, urged the media not to indulge in speculative reporting. Such reportage was likely to cause misunderstandings.

    Sohrabuddin's brother Rubabuddin Sheikh, whose petition in the Supreme Court led to fresh investigation in the case, demanded Mr. Shah's resignation as he was “summonedâ€￾ by the CBI.

    BJP on Friday said its top leaders decided against attending the lunch hosted by Prime Minister Manmohan Singh to protest against "misuse" of CBI by summoning Gujarat Minister Amit Shah in connection with the Sohrabuddin Sheikh encounter case.

    Addressing a press conference, senior BJP leaders Sushma Swaraj and Arun Jaitley said they along with L K Advani and BJP chief Nitin Gadkari had received the invitation for the lunch which they had accepted.

    "We met yesterday and decided not to go for the lunch which was conveyed this morning. This is to protest against the misuse of CBI in Gujarat," Swaraj told reporters after a meeting of the top leaders here.

    She said Advani had raised the issue of "misuse" of CBI with Finance Minister Pranab Mukherjee but government did not pay heed.

    Jaitley termed the summoning of Shah as "political vendetta" and alleged that CBI has become the "extended arm" of the ruling party. "The timing of this is chosen for the political convenience of the Congress party," he added.

    'Atmosphere too bitter' to lunch with PM, says BJP

    New Delhi: Stung by the CBI summoning its top Gujarat Minister Amit Shah for questioning in a criminal case, the BJP has gone on a counter-offensive slamming the government for what it calls the "shameless misuse of the CBI" for political benefit.
    Senior BJP leaders - LK Advani, Nitin Gadkari, Sushma Swaraj and Arun Jaitley - skipped a lunch hosted by the Prime Minister on Friday to record their displeasure. "The atmosphere is too bitter for us to lunch with the PM," Sushma Swaraj at a press conference in Delhi.

    Amit Shah, Minister of State for Home in Narendra Modi's government, has been asked to appear before the CBI in connection with the Sohrabuddin fake encounter case of 2005.

    The BJP says the government is misusing the CBI to defame the Modi government. "The acts are concocted and false", Arun Jaitley said, adding that the CBI had become an extended arm of the ruling party. "Timing has been chosen for the political convenience of the Congress party. What kind of precedent are they setting?" he asked.


    Jaitley said the government was using the CBI to trap political opponents and to save its own people. He alluded to crucial votes in Parliament and alleged there was a connection between different parties voting with the government and "the CBI's change in stand."

    The Amit Shah episode was an example of this, Jaitley said, adding that the "CBI is following a political agenda on baseless facts."

    Swaraj said LK Advani had called Finance Minister Pranab Mukherjee on Friday morning to inform him that the PM's lunch, being held at his home, would not be attended by the BJP.

    On Friday morning, the top leaders of the BJP met at Advani's house to discuss the party's strategy in the face of the huge embarrassment caused by the summoning of Amit Shah. The party is said to be worried that Narendra Modi, looked upon as one of the BJP's biggest strengths, is being undermined.

    The timing of the Amit Shah episode is also critical. It comes just before the beginning of the monsoon session of Parliament. The BJP is armed with a slew of issues to attack the Congress-led UPA government with and the government may just have deflected some of that negative focus.

    Amit Shah was asked by the CBI to meet its officials in Ahmedabad by 1 pm on Friday. However, minutes before the deadline expired, his lawyer requested the CBI for more time, asking also for details of the sort of questions that are likely to be put to the minister. (R
    Sohrabuddin Sheikh and his wife, Kauser Bi, were killed in 2005 by the Gujarat Anti-Terror Squad. The government has admitted in court that the police's original claim - that Sohrabuddin was a Lashkar-e-Toiba terrorist who planned to assassinate Narendra Modi - was false. The CBI reportedly has phone records that show Shah was in close touch with the policemen who allegedly murdered Sohrabuddin. Those policemen are in jail now.

    Sohrabuddin case: Gujarat minister Amit Shah resigns

    NEW DELHI: Facing charges of murder and arrest, Gujarat minister of state for home Amit Shah, a close associate of chief minister Narendra Modi, on Saturday resigned from the state ministry.

    "As I landed here in Delhi, I have information that Amit Shah's resignation has reached my residence in Gandhinagar. On return, I will accept it and complete the formalities," Modi, who is here to attend the National Development Council meeting, said.

    Asked by reporters whether the resignation amounted to accepting that Shah was guilty, Modi said, "He was accepting it because under the Constitution, certain formalities have to be fulfilled".

    He said Shah would fight the issue legally and expressed confidence that judiciary would provide him justice.

    Shah's resignation comes a day after CBI charged him with kidnapping and murder of alleged gangster Sohrabuddin Sheikh and his wife Kauser Bi in November 2005.

    Though Shah has resigned still nothing was clear about his whereabouts.

    The CBI, which filed the chargesheet on Friday before a court in Ahmedabad, has already sent teams for arresting him after he refused to appear before an agency team by Friday's 1pm deadline for questioning.

    Shah's anticipatory bail application before the CBI court on Friday was rejected and his lawyers were planning to approach the Gujarat High Court.

    Attacking the Congress, Modi said, "The case against Shah was a revenge for its loss in the 2007 assembly polls when it had made Sohrabuddin a hero. This was a politically motivated action against Amit Shah and the BJP government in Gujarat to corner it and to put obstacles in development work it was carrying out".

    He said, "Shah is completely innocent and the charges against him are fabricated. The CBI is being misused by the Congress against its political rival".

    He said the BJP would go to the people along with those fighting the forces of terror.

    Modi said the Congress and central government had completely "failed" in all fronts in facing the challenges of Kashmir, Maoists and problems from Pakistan.

    "The Congress government at the Centre was fully using the CBI to target political rivals after it failed on all fronts," Modi said.

    He said, "The government failed on the prices issue and was faced with an unprecedented bandh. Srinagar is on fire and the government came back fully beaten at the Indo-Pak dialogue in Islamabad and the Maoists were replying by bullets in the fight in which innocent people were killed".

    In Ahmedabad, officials in the chief minister's office (CMO) said Shah's resignation has been accepted by Modi.

    Shah had failed to appear before the CBI on Friday for questioning for the second time in two days following summons issued twice.

    Shah's anticipatory bail plea shortly after he failed to show up before the CBI was on Friday rejected by special CBI court judge G K Upadhaya.

    CBI also sent teams to the office and residences of the senior BJP leader in Gandhinagar and Ahmedabad and recorded statements of Shah's staff but could not locate him.

    The probe agency tightened the noose around Shah, who has been named as an accused along with 14 others including some IPS officers in the chargesheet filed on Friday in the special CBI court.

    Shah has been listed as accused number 13 and the chargesheet notes he has not been arrested.

    A CBI statement said the 15 accused were booked in the fake encounter of Sohrabuddin and for brutally killing his wife Kausarbi. The CBI probe was spread over five states--Gujarat, Rajasthan, Madhya Pradesh, Andhra Pradesh and Maharashtra.

    About the summons to Shah, the statement said, "He did not appear and hence chargesheet was filed without his examination."

    Besides the murder charge, the other charges against all the 15 accused included criminal conspiracy, wrongful confinement, kidnapping and abducting to murder, extortion and destruction of evidence under various IPC sections.

    The CBI is conducting a fresh probe into the November 26, 2005 encounter at the behest of the Supreme Court after questions were raised on the investigations by the Gujarat police. Sheikh, an alleged gangster, was killed in an alleged fake encounter by Gujarat Police.

    The accused included IPS officers Abhay Chudasama, D B Vanzara, Dinesh M N and Rajkumar Pandian and eight other policemen. All of them are under arrest.

    "Yes, we have sent teams," CBI sources said but avoided a direct reply when asked whether teams have been sent to arrest Shah.

    New Delhi, Aug 28 (IANS) Gujarat police official Geetha Johri has moved the Supreme Court alleging that the Central Bureau of Investigation (CBI) was mounting pressure on her to point an accusing finger towards some politicians, including former minister Amit Shah, in the 2005 Sohrabuddin Sheikh killing.
    Additional Inspector General of Police Johri said in her petition filed Thursday that the CBI was forcing her to name as accused some politicians, including former Gujarat minister of state for home Amit Shah, who is currently in judicial custody.

    She said that the CBI threatened her with “wild charges, in order to pressurize†her to implicate Shah.

    Johri said that the CBI has used coercion and threats to extract a statement from her personal assistant Raju Acharya against her.

    She said CBI Additional Director Balwinder Singh, supervising the investigation, too should be questioned in the Sohrabuddin’s and his wife Kausarbi’s abduction and shootout killing.

    “Balwinder Singh should be one of the witnesses to be questioned, but he is the person who is deciding who is to be questioned in regard to the abduction of Sohrabuddin,†she said.

    Johri has made these allegations in a curative petition before the apex court seeking the expunging of adverse observations against her by the court in its Jan 12 judgment.

    She said that in the bench, which transferred the investigation to CBI, there was a judge who was himself being investigated by the CBI for offences related to the Ghaziabad district court provident fund scam.

    “How far it was proper for a judge under CBI investigation himself to order CBI investigation in another case - particularly when the other case is a politically sensitive case - touches upon the issue of judicial propriety,†said Johri.

    She said: “…being a dignified police Officer, the petitioner would not like to say anything more than bringing this fact to the knowledge of the court.â€

    Johri said in her petition: “…clearly there seems to be a political angle to the case and to the petitioner. This is evident from the manner in which first the amicus

    curiae Gopal Subramanium and then Harin Raval, who was assisting him, had been impressing upon the court to hand over the investigation to the CBI.â€

    She said that the third person who was taken off the bus along with Sohrabuddin and Kausarbi at Ahmedabad, three days before his killing Nov 26, 2005, was not Tulsi Prajapati but Kalimuddin alias Nayeemuddin, a former People’s War Group member who turned Andhra Pradesh police approver.

    Balwinder Singh was the police commissioner of Andhra Pradesh’s capital Hyderabad at that time.

    The petition said that Johri investigated the case “diligently and honestlyâ€. She said that she was even praised for her honest inquiry which led to the arrest of high police officials who are still in jail.

    Johri contended that after conducting the preliminary inquiry she should, as a matter of practice, have been withdrawn but the investigation was thrust upon her and today she is suffering.

    She said that at no stage, when investigation were being carried under her stewardship, there was any attempt to derail it.

    She said that she has been slammed by the apex court even though there was no material against her and that too without affording her an opportunity to present her side.

    Johri said that the CBI was using these observation of the court to threaten her with arrest in case she tried to defy the investigating agency.

    The apex court in the said judgment Jan 12 transferred the investigations into the Sohrabuddin-Kausarbi abduction and shootout killing case to the CBI.

    Congress is using CBI against its political opponents and CBI is doing that job well .

    Exactly. The CBI should investigate and make sure we have sufficient evidence to prosecute the suspects. And we should have fast-track courts delivering justice here. As for the Congress, they need to do likewise with the 1984 riots.

    The Congress and BJP have tried to hide behind each other's atrocities for a long time. We should not let this continue anymore.
