Committee not aware of charge sheet against CVC: Govt tells SC

    NEW DELHI: The government on Thursday told the Supreme Court that the issue of chargesheet against CVC PJ Thomas in a corruption case and sanction granted by Kerala government for his prosecution were not brought before the high-powered committee for selecting a candidate for the post.

    This was stated by attorney general Goolam E Vahanvati before a bench headed by chief justice SH Kapadia, which wanted to know if the issue of sanction and the charge sheet against Thomas was presented before the three-member committee headed by Prime Minister Manmohan Singh.

    "It was not before the committee. The material pertaining to the sanction for prosecution under section 120 B of the Indian Penal Code was not before the committee. The bio-data did not reflect this aspect before the committee," the attorney general said.

    The response of Vahanvati came on a question from the bench whether the material relating to the charge sheet and sanction was presented before the committee.

    "We are not going into the merits of the case. We want to know whether the material pertaining to charge sheet and the sanction were brought before the committee or not.

    "We want to know whether relevant material was brought before the committee and whether these documents were brought were before it," the bench also comprising KS Radhakrishnan and Swantanter Kumar said.

    The apex court said that it will decide whether non-placing of the information about chargesheet vitiated the selection process.

    The Supreme Court hearings on the fate of Thomas assumes importance as the apex court has questioned his appointment as he was facing corruption charges in Kerala.

    A PIL had challenged Thomas' appointment as the CVC, quoting the pamolein import corruption case in which he is an accused and the trial is on at vigilance court in Thiruvananthapuram.

    NEW DELHI: Slamming the government, BJP leader Sushma Swaraj termed as "untruth" its claim that the charges against CVC P J Thomas was not brought before the high-powered selection committee of which she was a member and said she would approach the Supreme Court in this regard.

    "It is not at all true. In fact, it is a mis-statement. I personally brought this fact to the notice of the Prime Minister and Home Minister in the meeting itself even though they persisted with this appointment," Swaraj said.

    The Leader of Opposition in Lok Sabha told reporters that she had always stayed away from judicial proceedings but "now I have decided to file my affidavit before the Supreme court".

    Swaraj, who had put on record her dissent to the selection of Thomas as CVC by the three-member committee, was reacting to the affidavit filed by Attorney General G E Vahanvati in the Supreme Court today that the panel was not aware of the charges in the Palmolein export case pending against him in Kerala.

    The main opposition party had even boycotted the CVC's swearing-in ceremony a few months back as a mark of protest.

    "The government is speaking one untruth after another untruth. So I have decided to file a detailed affidative on the issue," Swaraj said.

    She asserted that her main obection to Thomas' appointment was that there was chargesheet against him in a corruption case and sanction was granted by Kerala government for his prosecution.

    An NGO, Centre for Public Interest Litigation , and others had challenged Thomas' appointment as the CVC, citing the Pamolein import corruption case in which the top ranking official is an accused.

    Now, BJP drags PM into CVC row

    With the Supreme Court questioning the Government over the appointment of Chief Vigilance Commissioner PJ Thomas PJ Thomas, the BJP has lashed out at the Government once again. BJP drags Prime Minister Manmohan Singh into PJ Thomas' appointment controversy. The party is to file an affidavit to expose what they allege are Government's 'untruths'.

    General Secretary Ravi Shankar Prasad has now called upon the Prime Minister to clarify on the process followed to appoint Thomas to the post despite he being chargesheeted in the Palmolein Oil scam.

    Meanwhile, Leader of Opposition in the Lok Sabha, Sushma Swaraj, who was on the selection committee of the Central Vigilance Commissioner, plans to file an affidavit in court. According to Swaraj, she had objected to the appointment of the CVC and the Government had ignored her plea.

    It is clear that the govt. suppressed the info from the committee. That by itself is highly suspicious.

    Sushma had given her objectionsd very clearly. They should have been looked into, they were not.

    If govt was not aware of the chargesheet against Thomas, then it is a VERY, very sad state of affairs. Did the Dept of Personnel not do its job properly, maybe on a cue? DoPT is under control of PM.

    Now either Sushma is lying or the Govt is, and that means PM. Truth must come out.

    Centre in a dilemma as Thomas refuses to quit

    It seems like govt would have to twist PJ Thomas's arm to make him leave, using non-conventional methods if necessary.
