The Union home ministry, red-faced over a leaked internal note in which a joint secretary-level officer discussed the creation of Lok Sabha seats in Pakistan-occupied Kashmir, on Tuesday clarified that no such proposal was under its consideration.

According to sources in the ministry, the joint-secretary level officer had sought a clarification on the constitutional position vis a vis representation of PoK in the Lok Sabha, just like the region accounts for 24 seats in the J&K assembly that remain vacant.

"The officer concerned had doubts as to whether the provision for PoK's representation in the state assembly should also be applicable to the Lok Sabha... however, the constitutional position, which rules out any such arrangement at the parliamentary level, was explained to him and the matter ended there," a senior MHA official told TOI.

"I can assure you that no representation has been received from any political party, government or stakeholder in J&K for creating Lok Sabha constituencies for PoK," the official said and claimed that the option was, at best, stillborn, with neither the home minister or home secretary in the loop. However, observers viewed the ministry's clarification with scepticism, wondering if it was part of a ploy to lay the entire blame at the joint secretary's door to save the higher-ups.

A report in a section of the media had on Tuesday claimed that the proposal to provide Lok Sabha seats for PoK, which would need amendment of Article 81 of the Constitution, was reviewed at the level of the home secretary. Considering the ramifications of such a move on the sanctity of the Line of Control and India-Pakistan relations, a home ministry spokesperson issued a prompt denial, saying "there is no such proposal under consideration of MHA".
