    The Supreme Court has struck down the appointment of PJ Thomas as the CVC. The SC has called his appointment illegal and has said he must go.

    The Supreme Court pronouncedthe verdict right now on the basis of petitions challenging the appointment of former bureaucrat P J Thomas, who is facing a corruption case in Kerala.

    A bench of Chief Justice S H Kapadia and Justices K S Radhakrishnan and Swatanter Kumar had reserved its judgment on February 10. The public interest litigation filed by an NGO, Center for Public Interest Litigation, and retired bureaucrats and police officials, including former Chief Election Commissioner J M Lyngdoh, had challenged Thomas' appointment to the post in view of a pending criminal case against him in a Kerala court. Thomas was appointed CVC on September 7 last year.

    So what. Our PM is SOOOO helpless he dare not remove Thomas. PLUS Thomas happens to be from a minrority community, as does our CEC. This PM declared from rampart of Red Forst: Muslims have have the FIRST claim on resources of India!!

    This verdict is a slap in the face of pro corruption prime minister and home minister,

    Decision on Thomas a historic day for rule of law: BJP

    The BJP said the Supreme Court decision quashing the appointment of P.J. Thomas as the Central Vigilance Commissioner has helped restore the “dignity” of the constitutional post and it was a “historic verdict.”

    “The dignity of the office of CVC has been restored,” Sushma Swaraj, Leader of the Opposition in the Lok Sabha, said shortly after the Apex Court’s decision.

    Ms. Swaraj, who was part of the three—member panel headed by Prime Minister Manmohan Singh, had opposed the appointment of Mr. Thomas as CVC and had given a dissent note. Union Home Minister P. Chidambaram was the other member.

    BJP spokesperson Ravishankar Prasad said it was a “historic” day for the Rule of Law and that Mr. Thomas was tainted.

    Another BJP leader Yashwant Sinha said the Prime Minister should take “full responsibility” for the turn of events involving Mr. Thomas’s appointment as CVC.

    CPI’s D. Raja said the court decision was a “big blow” for the Union Government.

    The Leader of Opposition Sushma Swaraj had raised the issue with the PM & HM regarding the chargesheet against Thomas and asked them to delay the appointment by a couple of days.. One wonders what was the hurry on part of the PM and the HM.. The PM should wake up from his slumber and avoid demeaning the Office of the PM further..

    MMS is helpless. If Sonia wants Thomas, he can do nothing.

    Delhi Minister Chowhan has been indicited. But can he be sacked without Sonia's nod?

    Sushma Swaraj vindicated

    In her first reaction to the quashing of CVC appointment by the Supreme Court today, leader of opposition in Lok Sabha Sushma Swaraj tweeted "The dignity of the office of CVC has been restored". BJP spokesman Rajiv Pratap Rudy said that the verdict is a huge blow for the UPA government, Sonia

    Gandhi and Manmohan Singh. There has to be a moral responsibility
    for "Mr Clean" (PM).

    High-powered committee which took this decision comprised of PM Manmohan SIngh, Home Minister P Chidamabaram and Sushma Swaraj. At that time Swaraj had objected to Thomas' appointment. She accused Chidambaram of informing the committee that Thomas had been acquitted in the Palmolein case.

    While striking down the CVC appointment, the Supreme Court said that the high-powered comittee's recommendation on appointment of Thomas "does not exist in law".

    Apex court rejected the contention of Thomas and the government that the appointment of the CVC cannot be brought under judicial review. SC says legality of the recommendation can be brought under judicial review.

    SC said any future appointment should not be restricted to civil servants alone but people of impeccable integrity from other fields should also be considered.

    no .after this verdict Manmohan and home minister has no moral right to continue they must resign like thomas

    I am reposting what I wrote in another thread....Congressis have gone insane.

    From day one, they knew about CVC yet they tried to hide it. There is only one reasonable explanation to it: they were trying to put their man in place.

    Lastly hats off to supreme court. A historic decision indeed.

    PM must explain Thomas appointment in parliament: Yechury

    Prime Minister Manmohan Singh has to explain in parliament the appointment of PJ Thomas as central vigilance commissioner (CVC), Communist Party of India-Marxist (CPI-M) leader Sitaram Yechury said

    Thursday after the Supreme Court ruled that the bureaucrat could not continue in office. "The p

    minister needs to answer in parliament how they went ahead despite all the facts known to everybody...even the leader of opposition (Sushma Swaraj) objected to that. They have to answer. He needs to explain..." said Yechury, adding that he was going to raise the issue in parliament.


    Yechury, a Rajya Sabha MP, said Thomas' appointment should not have taken place and the apex court has vindicated what he had said earlier.

    The apex court said the appointment made by the high-powered committee, consisting of Prime Minister Manmohan Singh, Home Minister P. Chidambaram and Leader of Opposition Sushma Swaraj does not exist in law.

    The apex court gave its verdict on a petition by the Centre for Public Interest Litigation (CPIL) challenging Thomas' appointment.

    The petitioner had said that Thomas was facing a criminal chargesheet in a case related to palm oil import in Kerala and he was not an "outstanding civil servant of impeccable integrity".

    I am beginning to feel that our courts are the last thin ropes by which our democracy is still hanging. Otherwise, common man in india has become too helpless to expect anything good from mighty and insensitive politicians.

    Today I’m very happy that the rule of law has won. This dead democracy was becoming nothing but a pain for shoulders. But the supreme court has shown the govt. that nobody is above law.

    But still much has to be done. Just giving verdict that The appointment was illegal is not enough. For the irresponsible behavior shown by Manmohan and Chidambaram to the people of Bharat, the Supreme Court should also put Manmohan and Chidambaram behind the bar for atleast one day and one night in the same jail where Dehli police use to put the those drunked (bewaarre) people who roam in streets in night. Only that way they will realize that they have brought the same thing to the nation that a drunked man brings to the nation i.e SHAME.

    I’m not going to ask if they have because I know hardly any politician have it but still in their lifetime if they have ever heard anything about moral value , shame etc they should immediately resign.

    @ Chief justice of Bharat. Sir, you commands the utmost respect. I salute you. :fans:
