Supreme Court sends notices to top BJP leaders in the Babri Masjid demolition case

    I'm very disappointed in Justice Balakrishnan. Had great expectations of him. But while Kapadia's stint as the chief justice seems to be headed for a glorious and active tenure, Balakrishnan's seems headed towards ignominy and a legacy of scandal.

    New Delhi: The Supreme Court has sent notices to top BJP and Sangh Parivar leaders on the CBI's plea against dropping conspiracy charges in the Babri Masjid demolition case.

    The Central Bureau of Investigation (CBI) had moved the Supreme Court challenging an Allahabad High Court order that dropped charges of criminal conspiracy against top Bharatiya Janata Party leaders including L K Advani and Murli Manohar Joshi.

    In its appeal, the agency said that the High Court had not come to the right conclusion and the charges of criminal conspiracy should be restored against them.

    The Allahabad High Court had on May 20, 2010 dismissed the CBI plea seeking revival of criminal conspiracy charges against top BJP and Sangh Parivar leaders which also included Ashok Singhal, Giriraj Kishore, Vinay Katiyar, Vishnu Hari Dalmiya, Sadhvi Rithambara and Mahant Avaidya Nath.


    The other leaders were former Madhya Pradesh Chief Minister Uma Bharti and former Uttar Pradesh Chief Minister Kalyan Singh, besides Shiv Sena supremo Bal Thackeray.

    Justice Kapadia deserves kudos for restoring the faith in Judiciary and keeping an effective check on the Executive..

    Btw, this is normal legal practice. Whenever any party(in this case, the CBI) appeals a verdict in the SC, the court issues notices to respondents named. To assume that the Court is somehow calling anyone to book by doing that is to be plain silly. Sadly that is the level of discussion these days.

    in our country only notices are served, notices after notices. nothing constructive is done.

    Would you rather have us abandon judicial procedures?

    An active and efficient judicial system, however slow, is pre-requisite of a democratic system.
