The French government wants to bring the state of emergency into the common law

    In a government bill, the main measures of this exceptional regime are integrated to ordinary law.

    A state of emergency without state of emergency: it is, in short, the content of the government text, submitted to the Defense Council on Wednesday and revealed by Le Monde.

    The draft law "Strengthening the fight against terrorism and internal security" would bring back to the ordinary law almost all the administrative measures of the state of emergency, which the government wishes to extend at first, before getting out of it it in favor of this text.

    In other words, circumvention of the judicial authority would no longer be the exception but the rule. A whole symbol: the bill bears the only signature of the Home Minister Gérard Collomb, and not that of the Justice Minister,François Bayrou.

    Security Arsenal

    Three-month residency assignments, administrative searches, exploitation of digital data, computers and other seized mobile phones, closure of a place of worship: these measures would now be the prerogative of the Ministry of the Interior and the prefects,without the intervention of a judicial judge, under the sole control of the administrative judge and the Council of State.

    "Any person of whom there are serious grounds for believing that his conduct constitutes a threat of particular seriousness to public security and order" may thus be assigned to residence under the terms of this draft Law, almost identical to those of the state of emergency currently in force.

    The government also intends to return to the charge of surveillance of wireless communications by state services, even though the July 2015 intelligence law was censored by the Constitutional Council. In addition, placement under ankle monitors by decision of the Ministry of the Interior will be facilitated.

    In the Council of Ministers on 21 June

    The administrative closure of places of worship should also be "simplified": the prefects will be able to decide it when "the remarks kept there, the ideas or the theories which are diffused there or the activities which take place there, provoke to Discrimination, hatred, violence, the commission of acts of terrorism in France or abroad, or endorse such acts".

    The draft law could be discussed in the Council of Ministers on 21 June, along with the seventh draft law extending the state of emergency until 1 November. "To deny the individual freedoms, it would give reason to the terrorists," assures however the Minister of Action and Public Accounts Gerald Darmanin, Wednesday on the plateau of BFMTV. The trivialization - even the reinforcement, as parliamentarians have for the time being systematically toughened the government's provisions - of this security arsenal authorizes a certain perplexity.
    Council of State and Constitutional Council shall decide.
